By using this website and/or placing an order with Nick The Fish, you are signifying your acceptance with these terms and conditions. 

We may update and revise these terms from time to time, so please make sure to keep regularly checking these pages. 

Glossary

1.1 When we refer to “Nick The Fish”, “we”, “us”, “our” we mean Nick The Fish Limited. 

1.2  When we refer to “you” or “your” we mean you, the person accessing the Nick The Fish website to consider placing an order. 

1.3 “website” means www.nickthefish.net

1.4 “products” mean the items available for sale on our website www.nickthefish.net

1.5 “order” refers to the products purchased from us and scheduled for either a one-off or recurring delivery.

1.6 “subscription order” refers to an order you’ve asked us to deliver to you every month until you tell us otherwise.

1.7 “delivery” means the physical delivery of the products you have ordered to your designated address.

1.8 “order deadline” is the time and day after which you can no longer make any changes or cancel your order. 

1.9 “in-person orders” refer to purchases made from Nick The Fish at markets or events. “Online orders” refer to one-off or recurring orders placed via our website www.nickthefish.net

2.1 Nick The Fish is run by Nick Sutherton and operates from Pebble Close Business Village, 3 Pebble Close, Amington, Tamworth, B77 4RD.

Products

3.1 We regularly review the prices of our products and delivery, and reserve the right to change the prices displayed without notice. 

3.2 Whilst we take every care to ensure our product descriptions, photographs and any accompanying information is accurate, we cannot accept liability for any inaccuracies, errors or omissions. 

3.3. All our products are subject to availability. Should any of the items you have ordered be temporarily out of stock and therefore unavailable for your selected delivery date, we will substitute the item with a similar product. Should our alternative selection not be suitable for you, we can remove the item from your order and arrange a refund. 

3.4 Our products are priced per unit, as due to the nature of our products, weights can not be guaranteed. 

3.5 Any allergens in our products are stated on the product label.  If you have any specific dietary requirements or are unsure about the suitability of any of the products then please get in touch for more information. 

Order Requirements

4.1 To place an order with us, you must be 18 years of age or over. 
4.2 To place an order you will be asked to enter your email address and full contact details., and also provide payment details for the goods ordered.

4.3 It is your responsibility to ensure the details you provide us with are complete and accurate, including your delivery address and any special instructions. 

4.4. If any of your details change you must inform us by contacting us by email as soon as possible, and definitely before the order deadline. 

4.5 It is your responsibility to keep your account safe, as you are responsible for any orders that are placed, modified or cancelled using your email address and account. If you suspect any fraudulent activity affecting your email or account, please contact us to inform us immediately. 

4.6 We reserve the right to cancel or suspend any orders without discretion.

Your Orders

 5.1 You can order from us in a number of ways. In person when we’re out and about at markets and events, or you can place a one-off or recurring subscription order online via our website.

5.2 Online orders may be subject to a minimum spend, see website for details. 

5.3 When you place an online order, you must select how frequently you wish to receive the order, either just once or on a recurring basis. 

5.4 After placing an online order, you will receive a confirmation email with your order details and delivery date. 

5.5. If you have placed a recurring order, your order will be delivered each month, on the same day each month (i.e. on the 1st, 2nd, 3rd or 4th Friday each month whichever option you have chosen when you place your initial order) until you pause or cancel your subscription order.  

5.6 Please check you receive an order confirmation email from us to ensure your online order has successfully been processed. If you don’t receive an email, please check your spam or junk folders before you contact us, to check the email hasn’t ended up in there.  If you don’t receive confirmation, or spot any errors on the order confirmation, please contact us immediately. 

5.7 We reserve the right to suspend or cancel your order if your online payment cannot be processed. Should any payment issues arise, a member of our team will contact you to advise next steps. 

5.8 Should you wish to amend or cancel any recurring subscription orders, just log into your account on the Nick The Fish website.  Recurring subscriptions can be cancelled at any point before the order deadline. The order deadline each week is midnight on the Tuesday before the Friday that your order is due to be delivered. As we are a small business selling perishable goods, we are unable to cancel your order or refund payment after the order deadline has passed.  Any cancellations after the order deadline will be assumed to refer to the next order. 

5.9 Should any of the items you have ordered be temporarily out of stock and therefore unavailable for your selected delivery date, we will substitute the item with a similar product. Should our alternative selection not be suitable for you, we can remove the item from your order at time of delivery and arrange a refund. 

Deliveries

8.1 As long as you are ordering within our standard delivery area, the price of delivery is included as part of the product prices shown on the website. 

8.2 We use our own drivers to deliver our products.  Your order will be delivered to you as specified in your order confirmation email that you’ll receive once an order has been placed, unless there is an event outside of our control.  If we, for whatever reason, are unable to meet the specified delivery date we will contact you with a revised delivery date.  Events outside our control include, but are not limited to, adverse weather conditions, strike actions, vehicle breakdown, traffic congestion, supplier failure, staff illness etc. 

8.3 You are responsible for making suitable arrangements to receive your delivery.  As all our products are frozen, the items in your order will need to be put straight into the freezer once delivered. So, if you will not be at home when we have arranged to deliver, please ensure you contact us with updated instructions.  We do not accept liability for loss or delay of the delivery should you not have made arrangements for safe delivery.  

8.4 Should your delivery be not accepted, or be refused from the address you have provided, we cannot take responsibility for this, so please ensure the delivery details you provide us with when you place an order are correct.  

8.5 We can only deliver within our operating area, so please check that  we deliver to your address before you place an order. You can check our delivery area http://nickthefish.net/areas-we-cover/ 

8.6:  FORCE MAJEURE. The Supplier shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, courier delays, strikes, lock-outs, accidents, war, fire or failure of any communications. 

Complaints, Returns & Refunds

9.1 We have grown our business by providing excellent customer service, so want you to be completely satisfied with your order.   Should you have any problems, or be not happy with your order for any reason, please contact us so we can see how we may rectify the situation.  All our contact details are available on our website. 

9.2 Any refunds or replacements are made entirely at our discretion. 

Offers & Promotions

11.1 From time to time we may run certain promotions for eligible customers for online orders. 

11.2 Should you wish to use a promotional code for an order, please enter it at time of checkout. Unfortunately, we cannot honour any codes entered after the checkout process is completed.

11.3 You may only use one promotional code per order, at the time of placing an order. Codes cannot be applied retrospectively to a previous order or delivery.

11.4 The FIRST ORDER offer only applies to new customers when placing a new subscription order with the Fish Club subscription service. This 20% offer is not valid for use against the Create Your Own Order as this is a one-off custom order from the online shop not a fish club subscription box.

11.5 Promotional codes can only be used for online orders and no cash alternatives can be offered. 

11.6 We reserve the right to cancel an order if an unauthorised promotional code has been used.

11.7 We reserve the right to end offers or promotions at any time. 

11.8 All our offers and promotions are subject to specific terms and conditions.
